Terms & Conditions | Garden Buildings Installation & Supply
Company:
Altha UK Ltd (Company No: 14750302), trading as Composite Garden Rooms, whose registered address is: Unit B, Block 10, Ripon Business Park, Charter Road, Navigation Way, Ripon, North Yorkshire, HG4 1AJ.
Customer:
The person(s), firm, or company purchasing a garden building, product, or service from the Company.
Installation Site:
The address or location specified by the Customer for the installation of the garden building, product, or service.
Garden Building:
The garden building or service specified in the Order Form and/or Order Confirmation, excluding any optional extras.
Non-Structural Elements:
Any components of the garden building or product that are not structural elements or optional extras, including (without limitation) fascias, trims, floor coverings, electrical installations, appliances, heaters, doors, windows, accessories, telecoms, network cabling, and external connections.
Optional Extras:
Additional items supplied by third parties and specified in the Order Form.
Order Confirmation:
The written confirmation issued by the Company following receipt of an order and the required deposit.
Property:
The land or premises upon which the garden building, product, or service is installed.
Structural Elements:
The floor, roof, and external walls of the garden building, product, or service.
Effective Date:
These Terms and Conditions were revised on 16 December 2025 and supersede all previous versions.
1. Basis of Sale
1.1 Any Customer entering into an agreement with the Company is deemed to have accepted these Terms and Conditions.
1.2 This Agreement constitutes the entire understanding between the parties.
1.3 Any advice not confirmed in writing is relied upon at the Customers own risk.
1.4 Errors in documentation may be corrected without liability.
1.5 Statutory references include amendments and re-enactments.
1.6 Headings are for convenience only.
1.7 Obligations are joint and several where multiple Customers apply.
1.8 The Company may amend these Terms at any time.
1.9 Variations are only valid if agreed in writing by the Company.
1.9.1 If any provision is unenforceable, the remainder shall continue in force.
1.9.2 This Agreement is governed by English law.
2. Orders
2.1 Orders are accepted only upon issuance of an Order Confirmation following receipt of the deposit.
3. Customer Warranties
The Customer warrants that:
3.1 Adequate electricity supply will be available during installation.
3.2 Safe access to the Property will be granted until payment is complete.
3.3 Access routes support vehicles up to 3.5 tonnes.
3.4 The installation site is level, stable, and prepared.
3.5 The Customer is the legal owner of the Property.
3.6 All required permissions have been obtained, including planning and lender consent.
3.7 The site is free from subsidence or land instability.
3.8 Installation complies with all applicable regulations.
4. Installation
4.1 Installation is carried out by the Companies team unless otherwise agreed.
4.2 Installation dates are approximate.
4.3 Reasonable care will be taken to avoid property damage.
4.4 Installation may be deferred if site conditions are unsuitable.
4.5 Upon completion, a checklist will be signed and keys handed over. Electrical connection remains the Customers responsibility.
5 & 6. Company Warranty
5.1 The garden building is warranted against material or workmanship defects for 12 months. Structural elements are warranted for 10 years subject to prompt payment.
5.2 The Company will rectify qualifying defects.
5.3 Non-structural defects must be reported within 30 days.
5.4 Replacement items are covered for the remainder of the warranty period.
5.5 Liability for death or personal injury is not excluded.
5.6 No warranty applies where Customer warranties are breached or site instability occurs.
5.7 Optional extras are covered only by manufacturer warranties.
5.8 Doors and windows carry manufacturer warranties only.
5.9 No warranty applies for storm damage or misuse.
6.0 No warranty applies for normal wear and cosmetic changes.
6.1 Alterations invalidate warranty unless approved in writing.
6.2 Garden buildings are not designed for habitable accommodation.
7. Alteration in Specification
The Company may alter specifications where required without affecting function or quality.
8. Property and Risk
8.1 Risk passes upon handover of keys.
8.2 Ownership transfers only upon full payment.
9. Price and Payment
9.1 Prices are confirmed in the Order Confirmation.
9.2 Prices are valid for 90 days.
9.3 A 50% deposit is required; balance due on handover.
9.4 Payment must be made in full without deduction.
9.5 Prices may be amended at any time.
10. Cancellations
10.1 All garden buildings are made to order and are exempt from cancellation rights.
11. Failure to Pay
11.1 Interest may be charged on overdue sums.
11.2 The Company may remove the garden building if payment remains outstanding after 30 days.
11.3 Deposits are forfeited and removal charges apply.
12. Severability
Invalid provisions do not affect remaining terms.
13. Amendment
Changes must be agreed in writing by a Company director.
14. Assignment
14.1 Customers may not assign without consent.
14.2 The Company may assign freely.
15. Liability
Liability is limited to the price paid.
16. Force Majeure
The Company is not liable for delays beyond its control.
17. Insolvency
The Company may terminate immediately upon insolvency events.
18. Notices
Notices may be served by post or email.
19. Waiver
Failure to enforce rights does not constitute waiver.
20. Governing Law
These Terms are governed by the laws of England and Wales.
